Terms and Conditions of Sale - ShopClimbing
Introduction
The ShopClimbing online store is operated by the company SHOPCLIMBING, which holds the rights to and operates under the ShopClimbing trade name.
Article 1: Purpose
These Terms and Conditions of Sale (T&Cs) define the rights and obligations of the parties involved in the online sale of goods and services offered by ShopClimbing to consumers.
They apply, without restriction or reservation, to all sales concluded by ShopClimbing with consumers ("the Client") wishing to purchase climbing holds, training accessories, clothing, skincare products, and other equipment dedicated to climbing and sports ("the Product") on the website www.shopclimbing.com.
These T&Cs outline payment methods, delivery terms, and order execution processes.
Article 2: Product Features
2.1 Main Features
The Products listed on www.shopclimbing.com are described to allow Clients to understand their main characteristics, including specifications, illustrations, dimensions, and prices. Clients must review these details before placing an order.
2.2 Environmental Features
Some products are made using recyclable materials, while others may be repurposed for alternative uses.
Article 3: Validity of Offers
The availability of Products on www.shopclimbing.com is subject to stock limitations.
Article 4: Orders
4.1 Account Creation
Clients must create an account and provide the necessary information for billing and delivery.
4.2 Placing an Order
Clients select Products, validate their cart, and accept these T&Cs to confirm their order.
4.3 Order Confirmation
Upon successful payment, an email confirmation is sent to the Client’s registered email address.
4.4 Order Modification and Cancellation
Confirmed orders can only be modified or canceled in cases of force majeure or Product unavailability.
Article 5: Pricing
Prices are listed in euros, inclusive of taxes, excluding delivery fees. Delivery fees are calculated and displayed at checkout.
Article 6: Payment Terms
Full payment is required at checkout. Payments can be made via credit card or bank transfer (for professionals on orders exceeding €1,000 excluding VAT).
Article 7: Delivery
7.1 Delivery Terms
Products are shipped within mainland France to the address provided by the Client. The standard delivery time is 3 business days (up to 10 days maximum). For professional clients and resoling services, delivery may take up to two weeks.
7.2 Delivery Fees
Delivery fees are calculated based on the order total and are displayed at checkout.
Article 8: Returns and Withdrawal
Clients bear the cost of returns. Products returned in new condition will be fully refunded. For items showing signs of use, a credit note worth 80% of the purchase price will be issued. Claims must be made within two weeks of receipt.
Article 9: Warranty
Products come with a one-year warranty. Clients are responsible for shipping costs on warranty returns. ShopClimbing will assess eligibility for warranty coverage. Defective items will be replaced with new ones.
Article 10: Data Protection
ShopClimbing retains only the information necessary for account management and order tracking. These details are used internally and are never shared with third parties.
Clients may request account deletion by emailing information@shopclimbing.com. However, account deletion will result in the loss of account access and associated offers.
Article 11: Intellectual Property
All content on www.shopclimbing.com is the exclusive property of ShopClimbing. Reproduction is strictly prohibited.
Article 12: Disputes
In case of disputes, Clients are encouraged to contact ShopClimbing directly at information@shopclimbing.com for amicable resolution.
Article 13: Pre-Contractual Information - Client Acceptance
Placing an order on www.shopclimbing.com signifies full acceptance of these T&Cs.
